Terms of use
These Terms of Use govern access to and use of this website and the associated manufacturer, buyer and agency platform (together, "the Platform"). By accessing this website or creating an account, the user agrees to be bound by these Terms in their entirety.
Scope and eligibility
The Platform is intended exclusively for business use by manufacturers seeking marketing representation in Dubai, and by hotels, procurement desks and other professional buyers sourcing branded products from selected manufacturers. The Platform is not directed at, and may not be used by, consumers.
Accounts and registration
An account is issued to a company for its own use. The company is responsible for the accuracy of all information it submits — including product information, compliance evidence and artwork — and for maintaining the confidentiality of its sign-in credentials.
The Company reserves the right to suspend any account found to have submitted false compliance evidence or to have misused the Platform. No manufacturer's product shall be presented to a buyer absent a registration recorded by the Company itself, on the basis of evidence supplied by the manufacturer.
Orders, pricing and fees
The Company maintains two distinct and unrelated commercial relationships, which shall under no circumstances be combined in respect of the same order: (i) a disclosed design & branding services fee, applicable to hospitality amenity customisation and payable by the buyer; and (ii) a flat periodic marketing retainer, applicable uniformly across all sectors and payable by the manufacturer, which bears no relationship to the value or volume of any transaction.
The Company is not an agent, broker or intermediary in, and is not a party to, any contract for the sale of goods between a buyer and a manufacturer. Such contracts, including their negotiation, pricing, specification and performance, are concluded and performed solely between the buyer and the manufacturer.
A quotation shall not constitute a binding contract until accepted by the client. Upon acceptance, the fee and hardware estimate stated therein shall apply, subject to the terms set out in that quotation.
Intellectual property
The content of this website, including its text, layout, and the CapDUBAI name and logo, is the property of the Company or its licensors.
Artwork uploaded by a client in connection with its own order remains the property of that client. The client grants the Company only such licence as is necessary to place the artwork on the relevant product and to transmit it to the manufacturer for production and approval purposes.
Disclaimer of warranty
The Company generates and introduces business leads and, in respect of amenity programmes, provides design & branding services, but is not itself the manufacturer of any product and does not negotiate, contract for, or otherwise manage the sale of goods on behalf of either party. Product quality, conformity and warranty remain the sole responsibility of the manufacturer, under the terms agreed directly between the manufacturer and the client.
Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or the Platform, are governed by the laws of the United Arab Emirates.
Amendments
The Company reserves the right to amend these Terms at its discretion. The version published on this page, dated below, constitutes the version then in effect.
